EFCC’s suit against Kwankwaso stalled

The inability of the Economic and Financial Crimes Commission, EFCC to file court processes before a Kano High Court has stalled hearing in the suit instituted by the leader of the New Nigeria Peoples Party (NNPP) Rabiu Musa Kwankwaso and seven others seeking enforcement of their fundamental rights.


Other applicants in the suit alongside Kwankwaso, were the NNPP, Dr Ajuji Ahmed, Dipo Olayanku, Ahmed Balewa, Chief Clement Anele, Lady Folashade Aliu and Engr. Buba Galadima.


When the matter came up for hearing on Tuesday, counsel to the applicants, Bar. Robert Hon told the court that they were ready to proceed with the hearing.

“My lord, the respondent by the rules of this Court has five days to file their response but it is more than 30 days now. They are out of time. We served the respondent on the 10th of June with all the applications in their legal department. My lord this is a fundamental rights suit with a special procedure.”


Bar. Hon urged the Court to discountenance the respondent application seeking for an adjournment for not giving a genuine reason for not filing their response.

He therefore urged the court to adjourn the case for a definite hearing.

The respondent counsel, Idris Ibrahim Haruna, sought an adjournment to enable them to file their responses for a fair hearing.


“Service was affected in Abuja, we are very sorry for the inconvenience and applied for another day to enable us to file our responses.”

The presiding Judge, Justices Yusuf Ubale Muhammad, however, adjourned the case to 24th October 2024 for a definite hearing.


Recall that the Court had issued an order restraining the EFCC from infringing, intimidating, arresting or harassing the applicants until the determination of the motion on notice.
